Child Support Agency Court Presenting Service
The Child Support Agency (CSA) is an Executive Agency of the Department for Work and Pensions (DWP). Following the launch of its Operational Improvement Plan in 2006, the Agency has increased the resources employed on enforcing maintenance payment through the courts. As a result there is a corresponding need for expert legal resources to support court action. The CSA is therefore seeking a contract to undertake all required legal service provision and support the presentation in court. There will be no staff transfer from the Agency. The contract for this work is planned to be in place in January 2008 and is anticipated to last for a period of 2 years with an option to extend for up to 3 years.
The CSA employs approximately 9,500 people throughout the United Kingdom and is responsible for the calculation and collection of Child Maintenance from parents who live apart from their children. In a proportion of cases, non-resident parents fail to fulfil their maintenance responsibilities. Where administrative sanctions such as earning deductions are ineffective in terms of satisfying the debt, legal action through the courts is needed to compel payment and deter non-compliant behaviour.
The Agency has a requirement for a nationwide legal services contract or contracts to support Court Presentation. The requirement reflects the need for flexible, credible and professional enforcement action. It is intended to inform both in-house and contracted out provision of services in England & Wales and for Scotland. It includes the requirement for:
- Civil action support only, including Orders for Sale and Committal Proceedings;
- Coping with a sizeable increase in cases pursued through the courts including
- Disputed Parentage, Appeals, DEO Appeals, Small Claim actions and Appeals against Distress Action;
- Solicitors to represent the Agency where no lay court presenting officer is available;
- Formalising the arrangements for obtaining Solicitors where additional representation is needed - for example where the circumstances of a case are legally complex
- Provision of solicitor representation in Scotland, where lay presentation is not permitted; and
- Additional services associated with changing business priorities and changes in legislation.
Organisations interested in this work are requested to submit Expressions of Interest in response to this advert, requesting in writing an Invitation to Tender from the contact shown below (preferably by e-mail). Expressions of Interest must be submitted by 12.00 noon on 2 October 2007. There will be an opportunity to clarify understanding at a briefing event on 9 October 2007. (If you would like to attend this event please notify the contact below as soon as possible. A limited amount of further information regarding the Agency’s requirements will be sent with the Invitation to Tender. Responses to the Invitation to Tender will be evaluated and successful organisations short-listed. Following the drafting of this short list, bidders may be invited to present their proposals to the Agency, which may form part of the evaluation).
The Agency anticipates contracting the work to a Master Vendor/Managed Service, (although variant bids representing provision of the service by a single supplier will be considered) with the expertise, technical and operational capacity to deal with the full geographic and skills range specified above. Use of consortia and sub-contracting will be considered; details of any proposed consortia arrangements and/or sub-contracting will need to be highlighted. Proposals must be returned no later than 10.00 a.m. on 22 October 2007.
The successful organisation will:
- be able to provide a service with sufficient professional capacity to cover the full geographical spread of location to cover courts in England & Wales and Scotland;
- demonstrate a full understanding of the legislation governing CSA;
- be able to mobilise suitable levels of resource within very tight timescales;
- be able to provide sufficient numbers of suitable legal trained staff in the locations required;
- be responsible for training their own staff;
- work closely with the Agency and within current systems and processes regarding, Child Support legislation, the Data Protection Act, Security, the Freedom of Information Act and the Human Rights Act. There will be some limited opportunity, working within these policies and regulations, to demonstrate innovation in
- delivery of the proposed services;
- be required to provide secure accommodation;
- meet Client Service Standards.
